Alexandra Gerungan and Claudio Shallaby of ADCO Law co-authored an article in the Revista Brasileira de Alternative Dispute Resolution (RBADR) journal

Our Senior Partner, Alexandra Gerungan, and our associate, Claudio Shallaby, in collaboration with Fahmi Shahab, Executive Director of the Indonesian Mediation Center (PMN), and Raymond Lee, Mediator and Mediation Instructor at PMN, recently contributed to Revista Brasileira de Alternative Dispute Resolution (RBADR) journal. In the publication, they penned an article titled Mediation Ecosystem in Indonesia.
RBADR journal is organized by the Brazilian Center for Mediation and Arbitration (CBMA) and Forum Publishers from Belo Horizonte.
In Indonesia, mediation takes two forms: court-annexed mediation and out-of-court mediation. In recent years, the trend of settling disputes through out-of-court mediation has been increasing. Another interesting update is the Singapore Convention on Mediation (SCM), which recognizes settlement agreements resulting from mediation. So far, Indonesia has not yet signed and ratified the convention. Strengthening the legal framework to accommodate international mediation could be one of essential steps needed for Indonesia to join the SCM.
“We hope that this publication will provide an insightful overview of the evolving use of mediation in Indonesia and raise awareness of its benefits and encourage more people to consider it as a way to resolve their disputes,” stated Alexandra.
