Alexandra Gerungan
Alexandra Gerungan is a seasoned litigator with over two decades of experience in dealing with litigation and alternative dispute resolution. Alex, as she is more commonly known, has represented high-profile clients in a wide range of litigation and dispute resolution matters, including civil lawsuits, arbitration, employment, debt recovery and restructuring, insurance claims, police and anti-corruption investigations, compliance and internal investigations, as well as general corporate or commercial issues.
Alex has been recognized as a top litigator by numerous local and international legal publications. Alex received her bachelor degree from the University of Indonesia and her master degrees in European and International Business Law from Leiden University. She is the member of Chartered Institute of Arbitrators (MCIARB).

Practice Description
During her years of practice, Alex has been involved in numerous deals and transactions including :
- Advising, assisting, and representing a multinational construction firm in a series of disputes in the court of law and in arbitration in relation to their contract with the project owner, advising on the interpretation of the arbitration clause and on the competent arbitration body, provide recommendation on possible amicable settlement, represent in the arbitration proceeding, court hearings, and in negotiation for mutual settlement.
- Assisting, and representing multinational companies in civil court proceedings across Indonesia, providing strategic advice, providing court submissions (and English translations), attending court hearings, provide reports and recommendations.
- Advising multinational firms and companies on issues pertaining to arbitration (domestic and international) and alternative dispute resolutions, including grounds to arbitrate, arbitral rules and procedures in force, the applicability of expert determination and mediation, and enforcement of arbitral awards. > Assisting in providing an expert statement in an investment arbitration involving a leading coal mining company, providing advice on such issues as required permits/licenses, use of forest area, and relevant investment treaty.
- Advising and representing an Indonesian entity of a major Asian independent quality testing agency providing services of sampling, testing, and issuing certification for the quality of such minerals as coal, iron ore, and nickel ore in a civil court proceeding and police investigation related to certification they issued for quality of certain coal.
- Advising, assisting and representing an Indonesian independent power producer, and operator of a coal-fired power plant in Sumatera, a subsidiary of a major Chinese power generation enterprise in an arbitration proceeding related to the interpretation of a power contract.
- Representing a German-based supplier of offshore drilling equipment in (i) enforcing an international arbitral award in Indonesia against a defaulting Indonesian company (former lessee of the equipment), and (il) as a defendant in a series of court actions initiated by the Indonesian entity in a Jakarta court to challenge the enforcement process.
- Assisting and advising officers/executives of a large granite producer and supplier that were named suspects in an investigation conducted by provincial police relating to the alleged crime in forestry and environment and in a preliminary investigation by local police over an incident that took place in the company's mining area.
- Provide assistance and advice to foreign executives of the Indonesian subsidiary of one of the world's largest gold producers in relation to criminal complaints against it and other executives for alleged pollution through mine tailings.
- Advisory work regarding Indonesian Anti-Corruption Law to foreign law firms and multinational companies on issues related to Foreign Corrupt Practices Act (FCPA) or UK Bribery Act (UKBA).
- Assisting and advising employees and officers (Indonesian and expatriates) of major and leading multinational firms/manufacturers on anti-corruption investigations conducted by the offices of the Provincial Attorney, Attorney General, or the Anti-Corruption Commission.
- Providing counsel and assistance to an officer of a European leading digital processing products corporation in an investigation by an Asian anti-corruption agency.
- Providing advice and assistance to multinational companies on compliance-related issues from identifying breaches of company regulations/business code of conduct and conducting internal investigation/fact-finding exercises to taking disciplinary action and termination of employment.
- Conducting independent investigation in a major oil pump manufacturer relating to alleged unauthorized payments made to local institutions.
- Advising and assisting an Indonesian subsidiary of a US-based well-known agricultural producer in conducting internal investigations over suspected compliance issues involving unauthorized payments made to certain institutions and vendors.
- Assisting and representing a large Asian mining equipment manufacturer in bankruptcy/delay of payment procedures.
- Assisting and representing a multinational distributor company in the termination of employment of a director and employees due to serious misconduct and alleged criminal offenses, drafting/reviewing employment contracts, and company regulations, and advising on various manpower-related issues.
- Advising on, preparing, reviewing/commenting on, and negotiating commercial contracts such as settlement agreements, mutual termination (of employment) agreements, employment contracts, distribution/supply contracts, and loan agreements.
- Assisting multinational companies with corporate/commercial and transaction works, including establishment, shareholders' meetings, mandatory notifications/reports/ submissions, mergers/acquisitions, etc.
- Providing advice and legal assistance in power and energy projects, including on land acquisition, drafting/reviewing relevant contracts and documents such as land ownership, land sale and purchase deed, coal supply agreements, loan/security documents, and environment-related documents, regulatory works, liaise with local authorities (including notaries, land office, and head of the village).
- Advisory works on land/property/building issues, such as land title, building safety and management, zoning requirements, etc.
- Provide legal assistance/representation and advisory works on Indonesian e-commerce and personal data protection regime, including on such issues as permits/licenses required for e-commerce companies, use and disclosure of employees' personal data, and breach of customers' databases, and also in dealing with relevant government agencies.
- Advising on the use of media, right to respond to/clarify on publication, liaising with media/public relations consultant. Conduct legal due diligence exercises; brief team on the purpose/goal, and legal framework, review, and comment on the draft report, liaise with in-house counsels.
- Advising and assisting a worldwide US-based fast food franchisor on their franchise arrangement in Indonesia, including disagreements with the franchisee(s), license, and intellectual property rights issues.
- Assisting an Indonesian subsidiary of one of the world's largest gold mining companies in developing materials for in-house training for local staff members on Indonesian anti-corruption/bribery laws and regulations and internal compliance/code of ethics.
